Thirteen Days is More than Enough

Forget about the 25th Amendment or fresh impeachment charges. Our President is not above the law nor immune from arrest for serious crimes against the United States.

18 United States Code Section 2384 provides that whenever two or more persons conspire (agree) to overthrow or destroy by force the government of the United States, they commit the crime of sedition.

The objectives of criminal sedition include:

— forcefully preventing the execution of any law of the US;

— taking, seizing or possessing by force any property of the US, contrary to law; or

— opposing by force the authority of the US government.

The evidence clearly shows the our President and former NYC Mayor Giuliani and others, pursuant to a common plan, incited a crowd of citizens to march on the US Capitol and use whatever means necessary to interrupt the lawful process of certifying the results of the Presidential election.

An otherwise inexplicable delay in sending in adequate forces to protect the Capitol, Members of Congress and their staffs from the mob they incited is further evidence the conspiracy included officials charged with protecting the Capitol.

A properly informed FBI agent should swear an affidavit before a federal judicial officer and secure arrest warrants for both Trump and Giuliani, then serve both men and take them into federal custody pending further investigation.

The President is not above the law, and we need to stop acting as if he is. The DOJ policy against seeking the indictment of a sitting President should not be applied in these dire circumstances. He poses a continuing threat to the government of the United States. Once he is securely in federal custody, the Vice President can handle the next thirteen days and a peaceful transition.

If the President’s followers decide to revolt, the armed forces should put down the rebels with speed and maximum force.

This is not a time for handwringing. It is a time for law enforcement to do its job!
